To mitigate housing displacement in changing neighborhoods, policymakers sometimes establish preferences for impacted communities to access any openings that arise in affordable housing developments. But housing advocates charge these preferences violate the federal Fair Housing Act’s prohibition on discrimination, even when they benefit communities of color and result in more inclusive neighborhoods. What are the FHA limitations on residency preferences, and how are policymakers and practitioners addressing them?
